One Divorce Form Not Enough
If you're handling your divorce on your own, then you may think you just need to download a divorce form, and present it in court, and that will be that. Some websites that offer divorce forms online make it sound almost that simple, even if they do provide quick summaries informing you of the different legal requirements in each state. But the fact that each state has these different requirements means the process can get rather more complicated and time-consuming than the websites suggest. You are almost certain to need more than just the one or two basic forms.
The Petition for Divorce is the main form that you'll begin with in every state. In addition, if you and your spouse have agreed that this divorce is to be uncontested, virtually every state also requires a Marital Settlement Agreement form. This is the document in which you both list all your assets and debts, including real estate, household goods, bank accounts, insurance policies, and so on. Here you would also list your minor children and all the custody and visitation arrangements in detail.
Those are the two types of divorce documents everyone knows about and assumes they'll prepare. But depending on your circumstances, you are very likely going to have to fill out another divorce form or two, or most likely more than that. For example, some states require extra documents dealing in more detail with child support. And many states want you to fill out a financial affidavit separate from the Marital Settlement Agreement. This form is created much closer to the time of the actual court hearing, so it's as up to date as possible.
If you come to court to submit your documents, and some important divorce form is missing, then it's very possible your filing will be rejected and you'll lose the filing fee. Then you'd have to start all over, perhaps even hiring a divorce attorney at this late date, to make absolutely sure the forms are correct the next time. You may get some help from the website of your county court system, if they list the forms you need. But it's your job to be sure you have everything that's required, before you show up in court.
